Representation of appellants and appellees in state and federal appellate courts.
Examples of representation in this practice area include:
- In 2018, after having obtained a multi-million dollar verdict for an individual who blew the whistle on substantial wrongdoing and waste of public funds, Mr. Sprague successfully defended the verdict before the Pennsylvania Supreme Court following an appeal by the opposing party. In a case of first impression, the Court unanimously recognized and upheld the availability of non-economic damages (for emotional distress, humiliation, embarrassment and harm to reputation) under the state’s whistleblower law. This was the first appellate decision to do so in Pennsylvania and made new law for whistleblowers throughout the Commonwealth.
- After having won a multi-million dollar verdict for a university professor whose employment contract had been breached, Mr. Sprague successfully argued on appeal to the state’s Supreme Court that the award of substantial damages to restore his research program was appropriate.
